1. General

These Terms & Conditions apply to purchases made through Maison Niche, available at maisonniche.store.

By placing an order through Maison Niche, you agree to these Terms & Conditions together with our Privacy Policy, Shipping & Delivery information and Returns & Refunds policy.

2. Products

Maison Niche offers curated wall art and framed artworks.

We make every reasonable effort to display product colours, proportions and details accurately. However, colours may appear slightly different depending on your screen, device settings and lighting conditions.

Product dimensions, materials, frame finishes and other specifications are stated on the relevant product page.

Many Maison Niche artworks are produced individually after an order is placed.

3. Orders

By submitting an order, you make an offer to purchase the selected product.

After your order is placed, you will receive an order confirmation by email. We reserve the right to reject or cancel an order where necessary, for example because of an obvious pricing error, payment problem, product availability issue or suspected fraudulent activity.

If an order is cancelled by Maison Niche after payment has been received, the corresponding amount will be refunded.

Please check your order details carefully before completing your purchase, including your delivery address and selected product.

4. Prices and Payment

All prices shown in the store are the prices applicable at the time of purchase.

Where legally required, applicable VAT is included in the displayed price.

Maison Niche currently offers complimentary standard delivery to supported destinations in Germany, the European Union and the United Kingdom unless otherwise stated during checkout.

Available payment methods are displayed during checkout.

5. Shipping and Delivery

Each artwork may require production time before dispatch.

Estimated delivery times are:

Germany: approximately 5–10 business days
European Union: approximately 7–14 business days
United Kingdom: approximately 7–14 business days

These timeframes are estimates and may vary due to production, carrier delays, customs processing or circumstances outside our reasonable control.

6. Cancellations, Returns and Right of Withdrawal

Consumers may have statutory withdrawal rights under applicable consumer law.

For online purchases within the European Union, consumers generally have a 14-day right of withdrawal, subject to statutory exceptions.

Where a statutory exception applies to a product that has been individually made according to a customer’s specifications or clearly personalised, the right of withdrawal may not apply.

If you wish to cancel an order, please contact contact@maisonniche.store as quickly as possible. Once production has started, cancellation may no longer be operationally possible, without prejudice to any statutory rights.

7. Damaged, Defective or Incorrect Products

If your artwork arrives damaged, defective or incorrect, please contact Maison Niche as soon as possible.

Please provide:

• your order number
• photographs of the artwork
• photographs of the packaging
• a short description of the issue

Where appropriate, Maison Niche will arrange a replacement, refund or another remedy in accordance with applicable law.

Statutory warranty rights remain unaffected. EU consumers benefit from legal guarantees where goods are defective or do not match their description.

8. Incorrect Delivery Information

Customers are responsible for providing complete and accurate delivery information.

If an order cannot be delivered because an incorrect or incomplete address was supplied, additional delivery or replacement costs may apply where legally permitted.

Please contact us immediately if you notice an error in your address.

9. Intellectual Property

Unless otherwise stated, the Maison Niche website, branding, editorial content, product presentation, photographs, graphics and written material are protected by applicable intellectual property laws.

Artwork copyrights remain with their respective copyright owners, artists or licensors where applicable.

Purchasing an artwork or reproduction does not transfer copyright or reproduction rights to the customer.

Website content may not be copied, reproduced, distributed or commercially used without permission.

10. Customer Accounts

Where customer accounts are available, you are responsible for providing accurate information and maintaining the security of access to your account.

Customer accounts may be used to view orders, account information and other available services.

11. Third-Party Services

Maison Niche uses third-party services to operate the store, process payments, fulfil orders and provide delivery and technical services.

The store is powered by Shopify.

Where third-party services are used, their processing of personal information is addressed in our Privacy Policy.

12. Privacy

Personal information is processed in accordance with our Privacy Policy.

Please review the Privacy Policy before placing an order.

13. Website Availability and Errors

We aim to keep product information, prices and availability accurate.

If an obvious error occurs in pricing, product information or availability, Maison Niche reserves the right to correct the error and, where necessary, cancel an affected order and issue a refund.

We do not guarantee that the website will always be available without interruption.

14. Liability

Maison Niche is liable in accordance with applicable law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for intentional misconduct, gross negligence, injury to life, body or health, or mandatory consumer rights.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

For consumers, mandatory consumer-protection provisions of the country in which the consumer habitually resides remain unaffected where applicable.

16. Changes to These Terms

Maison Niche may update these Terms & Conditions from time to time.

The version applicable to an order is the version in effect when that order is placed.
